FOLEY, Ala. — The former Cactus Café in Foley is officially for sale.
During its regular meeting Monday, the Foley City Council voted to move forward with the property, which it declared a nuisance in February 2012.
According to city records, the two-story building is located at the intersection of U.S. Highway 98 and North Alston Street. It was owned by the Sutton family before the city made its declaration to prevent its deterioration.
The city made subsequent repairs, which records indicate total $104,025.38. During a public hearing in September, co-owner Bennett “Bubba” Sutton of Gulf Shores said he had been previously unaware of the city’s actions. However, City Administrator Mike Thompson argued that Bennett had been onsite during a city tour of the property to assess needed repairs.
The two also disagreed over the city’s efforts to work with the Sutton family to bring businesses into the building. During last month’s public hearing, Sutton had said City Economic Director Jeff Rouzie had been difficult to work with. But Thompson said he took offense at the claim.
That hearing ended with Sutton agreeing to work with the city to repay work done on the building and get its current status lifted.
“Notices were sent to the landowners and their attorneys giving them 30 days’ notice to either pay the assessment in full or contact the City for repayment in installments,” city records state.
But with Monday’s vote, the city is moving forward with its efforts to recoup what it spend.
The sale will be advertised for several weeks. But the current owners can still pay the lien in full and once again obtain the building before it is sold.
