The City of Orange Beach and Turquoise Place Condominium Association (COA) filed a joint motion to dismiss a lawsuit over a specially called meeting on Nov. 21, 2025, at which a settlement with Larry Wireman was unanimously approved.
As previously reported by GCM, the lawsuit filed against the city, council members and mayor on Dec. 12 last year claimed the city did not provide the amount of time required for a public meeting notice.
The Alabama Open Meetings Act states notice of meetings must be posted in the City Hall no less than 24 hours before the meeting is scheduled to begin.
Media were notified of the specially called meeting by City Clerk Renee Eberly in an email sent Nov. 21, 2025, at 9:30 a.m. In the email, she stated the public notice was posted on Nov. 19, 2025.
A statement from the city, following the recent joint filing for dismissal, reads, "The parties discussed the claims raised in the complaint and the remedies sought, as well as the actions taken by city staff in compliance with the Alabama Open Meetings Act and thereafter agreed to file a joint motion to dismiss the case."
Last year's Nov. 21 settlement resulted in a land exchange of three lots, including one located next to Turquoise Place, and the city paying Wireman $500,000.
The lawsuit was filed by Wireman in 2020 and according to the settlement agreement, this was the third attempt to settle the lawsuit.
He did not attend the Nov. 21, 2025, specially called meeting, but Mayor Tony Kennon said Wireman called before the meeting to tell the city he was appreciative of the settlement and was hopeful of good activity going forward.
