BAY MINETTE, AL - The fate of Jon Christopher Washington in the shooting death of Kenny Myers in February of 2012 was placed in the hands of the jury on Friday morning, May 16. The trial started on May 12.
As of noon the panel had been meeting for two hours, according to a court official.
Washington faced a murder charge in Myers death after a shooting on Marina Road on Feb. 8, 2012. Washington was free on $100,000 bond for most of the period leading up to the trial before it was revoked after he was arrested in an altercation in Auburn where he was living while awaiting trial.
His attorneys said at the time the shooting was accidental, but police described the fatal wound as a "contact wound" and charged Washington with murder.
Police said both men were drinking in the early hours at the time of the shooting. They were at a home owned by Washington's family and the .38 that fired the fatal bullet also belonged to the Washington family.
His trial was originally scheduled be begin in October, but his lawyer, Pascal Bruijn requested more time because the state “didn’t turn over evidence in a timely manner.” The evidence in question was a ballistic report.
Trial dates set for December and January were subsequently postponed because of a loaded docket that contained several other cases being defended by Bruijn including the high profile sex abuse case of 80-year-old Giuseppe Pino LoPorto.
