Manslaughter arrest made in Foley

FOLEY — One man is dead and another is arrested on manslaughter charges following a late-night traffic accident in downtown Foley.

According to a Foley Police Report, 41-year-old Donald Marlow Banks of Foley was injured Sunday night on South Cypress Street when the motorcycle he was riding collided with a pick-up truck driven by 32-year-old Michael Antonio Jones, also of Foley.

“They were both accelerating rapidly from a stop-sign on Cypress, going south,” Foley Police Lt. Thurston Bullock said in a telephone interview. “Their speed was excessive.”

According to the police report, that speed, along with the factor of alcohol, led to the crash.

Bullock explained that authorities then received a 911 call, with Foley Police and Fire departments, Med Star and Life Flight responding.

“It was in downtown Foley, so we responded pretty quickly,” he said.

According to the police report, Banks had injuries from the collision and was Life-Flighted to Baptist Hospital, but later died. Jones was arrested on charges of manslaughter,a traffic violation and driving under the influence of alcohol.

“He not only admitted that he had been drinking, but there were indicators,” Bullock said.

Testing revealed that Jones’ level of alcohol was .14, which is more than the legal limit of .08.

Jones also has a previous record dating back to March, when he was arrested for possession of marijuana.

As for this case, he is currently free on bond. However, authorities are still examining evidence.

“This case is still under investigation,” Bullock said, explaining that the Foley PD is receiving assistance from Daphne Police and Alabama State Troopers on the case.

In addition, the Baldwin County District Attorney’s Office has been consulted, he added, explaining that once the investigation is complete, evidence will be presented to a Grand Jury.
