Ice vending machine hinges on council decision

SPANISH FORT, Ala. — Plans to install a freestanding ice machine at Papa John’s convenience store on Spanish Fort Boulevard won’t possibly receive the green light from city planners until at least Oct. 11, pending the City Council’s determination on the use of the property in question.

The Planning Commission forwarded a positive recommendation to the council for an amendment to the city’s land use ordinance adding a section to the Table of Permitted Uses allowing for the freestanding machines, but the amendment will most likely not be considered until that body’s first meeting in October.

The commission voted unanimously—sans Tom Montgomery who was absent—during Monday’s regular meeting to postpone consideration of businessman Van Knight’s site plan for the proposal until the council makes its ruling on whether the use will even be allowed.

As written, the proposed amendment states ice machines would be allowed “as an accessory use only, in conjunction with a convenience store or other retail establishment.” If approved as a permitted use, future ice-machine requests will require commission approval and will only be allowed in B-2, B-3, B-4, B-5 and M-1 zoning districts.

The commission also voted to allow preliminary and final subdivision plat approval for a proposed low-density development on Bromley Road.

Building Official Bruce Renkert said the six-lot subdivision request would create lots in the range of two to four acres, each fronting Bromley.

The original plan for the property sought construction of high-density duplexes, but that request has been scrapped in favor of single-family dwellings on considerably larger lots, to be known as Shadow Creek Estates Phase 1.

In other business the commission approved a preliminary and final subdivision plat request for extraterritorial jurisdiction property located on the west side of Shambo Road. Oliver Bertagnolli is the property owner.

An informal work session will be held at 6 p.m. Sept. 27 in the conference room at City Hall.

The next regular meeting of the Planning Commission will be held at 6:30 p.m. Oct. 11, following a 6 p.m. work session at the Gathering Place in the Prodisee Center.
