Foley council members go into executive session

FOLEY, Ala. — After taking care of a light agenda on Monday, members of Foley City Council voted to go into executive session to deal with what Mayor John Koniar called a “dispute with a contractor.”

Koniar announced that the executive session would last about 30 minutes after which the meeting would be reconvened. He stated, however, that no formal action would be taken by the council on Monday concerning the matter.

Attorney Britton Bonner, in comments made during the meeting prior to executive session, said “litigation (is) imminent” in the matter.

During the council meeting, the mayor read a proclamation declaring Feb. 27, 2010, as Arbor Day in the city. Koniar pointed out that the city has been named a “Tree City, USA” for the 29th year. He also noted Arbor Day festivities on Feb. 27 will be held indoors at the Civic Center, a departure from past years. The tree giveaway will take place as usual with seedlings of numerous tree varieties given free to the public.

Carolyne Hollis, representing the Beautification Board, was on hand to receive the proclamation.

With Foley Police Department’s recommendation, council members approved a Restaurant Retail Liquor license for Fish River Grill 2 at 8272 Ala. Highway 59 South.

A number of board appointments were approved. Gary Pitts was appointed for another term to the Revitalization & Beautification Board; Skip Davis was appointed to another term on the Public Parks & Recreational Board; Joseph Bullard was appointed as an alternate member of the Zoning Board of Adjustments and Appeals.

With Kathy Danielson’s resignation from the Revitalization & Beautification Board, Pat Davis was appointed to fill the slot.

Two welcome signs were approved by resolution at a cost of $3,780.

A second reading of an ordinance was approved declaring certain property no longer needed by the city and authorizing its sale to Ellis Farms LLC. Councilman Charlie Ebert III abstained.

The council agreed to re-apply for an Alabama Department of Conservation and Natural Resources grant whose funds would be used to construct a pavilion at Graham Creek Nature Preserve.

Council members also approved $1,200 for underground storage tank registration and air permit application preparation by Payne Environmental Services in connection with fuel tanks at Public Works.

A resolution passed approving the Foley Volunteer Fire Department personnel roster as of Jan. 27, 2010. Also, a separate resolution declared certain items at the Fire Department surplus and authorizing its disposal.

A renewal agreement between the city and South Baldwin Chamber of Commerce was approved.

The council agreed to assume the street lighting in three subdivisions: Rivertrace, Abby Ridge and Hickory Bend. Councilman Ralph Hellmich noted the infrastructure in the three had been accepted by the city some time ago.

Council members agreed to memorialize a $1 million loan in connection with the Wolf Bay Lodge project going in at the old Wilson Pecan location.

Approval was also given for purchase of a breaching tool that would be used by Foley Police Department for door entries.
