Fairhope Planning Commission reapproves site plans for two restaurants after approval expires

Fairhope Planning Commission reapproved site plans for two new food establishments located on the Encounter Development site along Highway 181.

The site plans are for a new Foosackly’s location as well as a new dessert shop called Just Chillin’. According to plans, both buildings will be on the same lot and face each other.

While plans for both businesses were previously approved in 2025 — with the planning commission approving them on Feb. 3 and the city council following on March 10 — that approval has since expired because it only stands for 365 days from the approval date. The planning commission unanimously reapproved the plans during its meeting Monday, May 4.

Both establishments are part of a wider development in the area, where the famed house from the movie “Close Encounters of the Third Kind” currently resides, which is supposed to be moved to make way for other projects. Despite the developers receiving an 180-day extension in November to move the house, there is still no official word on when it will be relocated.
