UPDATE, 10:48 a.m.:
Bay Minette Police Chief and Executive Director of Public Safety James Rosier Jr. provided an update at about 10:48 a.m. Friday on the Sept. 9 shooting on Newport Parkway in a news release.
The 17-year-old male identified by police as the shooter has been charged with one felony count of first-degree assault and one felony count of shooting into an occupied vehicle, Rosier said.
Additional felony charges are being presented for two other individuals in the case.
During the execution of a search warrant, investigators seized a firearm, ammunition and several magazines, according to Rosier.
“The investigation is still ongoing,” the release said.
In an email accompanying the update, Rosier cautioned that the additional charges being presented for the two adults remain subject to review by the District Attorney's Office.
“The press release states that other felony charges are being sought for two adults but I would ask you to remember that the District Attorney has prosecutorial preference and while we anticipate cooperation, they have the right to amend (downgrade, change or even deny) our charges as they see fit,” Rosier said.

An 18-year-old man was wounded in a shooting Wednesday afternoon in Bay Minette, while police continued investigating the circumstances surrounding the incident and questioning two additional suspects.
According to a news release issued by James Rosier Jr., executive director of public safety and chief of police for the Bay Minette Police Department, officers responded at approximately 4:30 p.m. Sept. 9 to a report of shots fired in the area of the 1000 block of Newport Parkway.
“Upon arrival, officers determined that an 18-year-old male had sustained a gunshot wound to the upper leg,” the release said.
According to the release, the victim was transported to USA Medical Center in Mobile with non-life-threatening injuries.
During the initial response, officers detained a 15-year-old male who was found in possession of a stolen handgun. Investigators later determined the juvenile was not involved in the shooting, but he was arrested on charges related to possession of the stolen firearm.
As the investigation progressed, officers detained two additional suspects — a 17-year-old male and a 23-year-old male. The 17-year-old was identified as the shooter and was being questioned, according to the release. The 23-year-old also was being interviewed as part of the ongoing investigation.
Vehicles related to the crime were impounded and search warrants were being sought, according to the release. Additionally, a school bus was traveling through the area at the time of the incident with children aboard, the release said. No injuries were reported.
The release said the investigation remains active and that information could change as investigators continue pursuing leads.
“This information is fluid and subject to change as the Bay Minette Police Department is actively pursuing all leads and continues to work to determine the circumstances that led to this shooting,” the release said. “Further updates will be provided as the investigation develops.”
